Bu \u015fekilde davac\u0131, dava dilek\u00e7esinin sonu\u00e7 b\u00f6l\u00fcm\u00fcnde istemi\u015f olduklar\u0131ndan tamamen veya k\u0131smen vazge\u00e7mektedir. Davac\u0131n\u0131n feragat beyan\u0131 \u00fczerine davada esasa girilmeden ve bir h\u00fck\u00fcm kurulmadan karar verilmektedir. Feragat, kesin h\u00fck\u00fcm gibi sonu\u00e7 do\u011furmaktad\u0131r. Bu sebeple davac\u0131 feragat beyan\u0131ndan d\u00f6nememektedir. Davadan feragat ise iki \u015fekilde ger\u00e7ekle\u015febilmektedir:\u00a0<strong>S\u00f6zl\u00fc Feragat:\u00a0<\/strong>Davac\u0131, duru\u015fmada davas\u0131ndan s\u00f6zl\u00fc olarak feragat edebilir. Bu \u015fekilde, davac\u0131n\u0131n k\u0131smen veya tamamen feragat beyan\u0131 duru\u015fma tutana\u011f\u0131na yaz\u0131l\u0131r, imzas\u0131 al\u0131n\u0131r. Ancak; ke\u015fif s\u0131ras\u0131nda yap\u0131lan, ke\u015fif tutana\u011f\u0131na yaz\u0131lan ve davac\u0131ya okunarak imza ettirilen feragat de ge\u00e7erli bir feragat olmaktad\u0131r. Esas itibariyle feragat her \u00e7e\u015fit davada m\u00fcmk\u00fcnd\u00fcr. Davas\u0131ndan feragat eden davac\u0131 karar ve ilam harc\u0131n\u0131n \u00fc\u00e7te ikisini \u00f6deyecektir.
