Derece Arkeolojik Sit: Korumaya y\u00f6nelik bilimsel \u00e7al\u0131\u015fmalar d\u0131\u015f\u0131nda aynen korunacak sit alanlar\u0131d\u0131r.\u00a0 Bu alanlarda, kesinlikle hi\u00e7bir yap\u0131la\u015fmaya izin verilmemesine, imar planlar\u0131nda aynen korunacak sit alan\u0131 olarak belirlenmesine, bilimsel ama\u00e7l\u0131 kaz\u0131lar\u0131n d\u0131\u015f\u0131nda hi\u00e7bir kaz\u0131 yap\u0131lamayaca\u011f\u0131na, ancak;<br \/>\na) Resmi ve \u00f6zel kurulu\u015flarca zorunlu durumlarda yap\u0131lacak alt yap\u0131 uygulamalar\u0131 i\u00e7in m\u00fcze m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn ve varsa kaz\u0131 ba\u015fkan\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fcyle konunun koruma kurulunda de\u011ferlendirilmesine,<br \/>\nb) Yeni tar\u0131msal alanlar\u0131n a\u00e7\u0131lmamas\u0131na, yaln\u0131zca s\u0131n\u0131rl\u0131 mevsimlik tar\u0131msal faaliyetlerin devam edebilece\u011fine, koruma kurullar\u0131nca uygun g\u00f6r\u00fclmesi halinde serac\u0131l\u0131\u011fa devam edilebilece\u011fine,<br \/>\nc) H\u00f6y\u00fck ve T\u00fcm\u00fcl\u00fcsler de topra\u011f\u0131n s\u00fcr\u00fclmesine dayanan tar\u0131msal faaliyetlerin kesinlikle yasaklanmas\u0131na, a\u011fa\u00e7land\u0131rmaya gidilmemesine, yaln\u0131zca mevcut a\u011fa\u00e7lardan \u00fcr\u00fcn al\u0131nabilece\u011fine,<br \/>\nd) Ta\u015f, toprak, kum vb. al\u0131nmamas\u0131na, kire\u00e7, ta\u015f, tu\u011fla, mermer, kum, maden vb. ocaklar\u0131n a\u00e7\u0131lmamas\u0131na, toprak, curuf, \u00e7\u00f6p, sanayi at\u0131\u011f\u0131 ve benzeri malzeme d\u00f6k\u00fclmemesine,<br \/>\ne) Bu alanlar i\u00e7erisinde yer alan \u00f6ren yerlerinde gezi yolu d\u00fczenlemesi, meydan tanzimi, a\u00e7\u0131k otopark, WC, bilet gi\u015fesi, bek\u00e7i kul\u00fcbesi gibi \u00fcnitelerin koruma kurulundan izin al\u0131narak yap\u0131labilece\u011fine,<br \/>\nf) Bu alanlar i\u00e7erisinde bulunan ve g\u00fcn\u00fcm\u00fczde halen kullan\u0131lan umuma a\u00e7\u0131k mezarl\u0131klarda sadece defin i\u015flemlerinin yap\u0131labilece\u011fine,<br \/>\ng) Ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n mahiyetine tesir etmeyecek \u015fekilde ilgili koruma kurulundan izin almak ko\u015fuluyla birle\u015ftirme (tevhit) ve ay\u0131rma (ifraz) yap\u0131labilece\u011fine,<\/p>\n<p style=\"text-align: left;\">2) II. Derece Arkeolojik Sit ise; Korunmas\u0131 gereken, ancak koruma ve kullanma ko\u015fullar\u0131 koruma kurullar\u0131 taraf\u0131ndan belirlenecek, korumaya y\u00f6nelik bilimsel \u00e7al\u0131\u015fmalar d\u0131\u015f\u0131nda aynen korunacak sit alanlar\u0131d\u0131r. Bu alanlarda, yeni yap\u0131la\u015fmaya izin verilmemesine, ancak;<\/p>\n<p style=\"text-align: left;\">a) G\u00fcn\u00fcm\u00fczde kullan\u0131lmakta olan tescilsiz yap\u0131lar\u0131n basit onar\u0131mlar\u0131n\u0131n y\u00fcr\u00fcrl\u00fckteki ilke karar\u0131 do\u011frultusunda yap\u0131labilece\u011fine,<br \/>\nb) I. derece arkeolojik sit koruma ve kullanma ko\u015fullar\u0131n\u0131n a,b,c,\u00e7,d,e,f, maddelerinin ge\u00e7erli oldu\u011funa,<\/p>\n<p style=\"text-align: left;\">3) III. Derece Arkeolojik Sit alanlar\u0131 ise: Koruma &#8211; kullanma kararlar\u0131 do\u011frultusunda yeni d\u00fczenlemelere izin verilebilecek arkeolojik alanlard\u0131r.<br \/>\nBu alanlarda,<br \/>\na) Ge\u00e7i\u015f d\u00f6nemi yap\u0131lanma ko\u015fullar\u0131n\u0131n belirlenmesine, Ge\u00e7i\u015f d\u00f6nemi yap\u0131lanma ko\u015fullar\u0131n\u0131n belirlenmesinde;<br \/>\n&#8211; \u00d6neri yap\u0131 yo\u011funlu\u011funun, mevcut imar plan\u0131 ile belirlenmi\u015f yo\u011funlu\u011fu a\u015fmamas\u0131na,<br \/>\n&#8211; Alana gelecek i\u015flevlerin uyumuna,<br \/>\n&#8211; Gerekli alt yap\u0131 uygulamalar\u0131na,<br \/>\n&#8211; \u00d6neri yap\u0131 gabarilerine,<br \/>\n&#8211; Yap\u0131 tekni\u011fine ve malzemesine, Mevcut ve olas\u0131 arkeolojik varl\u0131klar\u0131n korunmas\u0131 ve de\u011ferlendirilmesini sa\u011flayacak bir bi\u00e7imde \u00e7\u00f6z\u00fcmler getirilmesine,<br \/>\nb) Varsa onayl\u0131 \u00e7evre d\u00fczeni ve naz\u0131m plan kararlar\u0131 ile yerle\u015fime a\u00e7\u0131lm\u0131\u015f kesimlerinde arkeolojik de\u011ferlerin korunmas\u0131n\u0131 g\u00f6zeterek, koruma ama\u00e7l\u0131 imar planlar\u0131n\u0131n yap\u0131lmas\u0131na,<br \/>\nc) Bu ilke karar\u0131n\u0131n al\u0131nmas\u0131ndan \u00f6nce Koruma Ama\u00e7l\u0131 \u0130mar Plan\u0131 yap\u0131lm\u0131\u015f yerlerde plan\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc ko\u015fullar\u0131n ge\u00e7erli oldu\u011funa.<br \/>\nd) Bu alanlarda, belediyesince veya valilik\u00e7e in\u015faat izni verilmeden \u00f6nce, ilgili m\u00fcze m\u00fcd\u00fcrl\u00fc\u011f\u00fc uzmanlar\u0131 taraf\u0131ndan sondaj kaz\u0131s\u0131 ger\u00e7ekle\u015ftirilerek, sondaj sonu\u00e7lar\u0131n\u0131n bu alanlarla ilgili, varsa kaz\u0131 ba\u015fkan\u0131n\u0131n g\u00f6r\u00fc\u015fleriyle birlikte m\u00fcze m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce koruma kuruluna iletilip kurul karar\u0131 al\u0131nd\u0131ktan sonra uygulamaya ge\u00e7ilebilece\u011fine,<br \/>\ne) III. Derece arkeolojik sit alan\u0131 olarak belirlenen arkeolojik sit alanlar\u0131nda koruma kurullar\u0131n\u0131n, sondaj kaz\u0131s\u0131 yap\u0131lacak alanlara ili\u015fkin genel sondaj karar\u0131 alabilece\u011fine,<br \/>\nf) Ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n mahiyetine tesir etmeyecek \u015fekilde ilgili koruma kurulundan izin almak ko\u015fuluyla birle\u015ftirme (tevhit) ve ay\u0131rma (ifraz) yap\u0131labilece\u011fine,<br \/>\ng) Bu alanlarda, ta\u015f, toprak, kum vb. al\u0131nmas\u0131na, kire\u00e7, ta\u015f, tu\u011fla, mermer, kum, maden vb. ocaklar\u0131n\u0131n a\u00e7\u0131lmamas\u0131na, toprak, curuf, \u00e7\u00f6p, sanayi at\u0131\u011f\u0131 ve benzeri malzemenin d\u00f6k\u00fclmemesine,<br \/>\nh) \u00dclke enerji \u00fcretimine getirece\u011fi katk\u0131 ve kamu yarar\u0131 do\u011frultusunda bu alanlarda koruma kurulunca uygun g\u00f6r\u00fclmesi halinde r\u00fczgar enerji santrallar\u0131 yap\u0131labilece\u011fine,<br \/>\ni) Sit alanlar\u0131ndaki su \u00fcr\u00fcnleri \u00fcretim ve yeti\u015ftirme tesislerine ili\u015fkin y\u00fcr\u00fcrl\u00fcktesi ilke karar\u0131n\u0131n ge\u00e7erli oldu\u011funa,<\/p>\n<p style=\"text-align: left;\">4) Kentsel Arkeolojik Sitler: Arkeolojik sitlerle, 2863 say\u0131l\u0131 Yasan\u0131n 6. Maddesinde tan\u0131mlanan korunmas\u0131 gerekli ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 i\u00e7eren ve ayn\u0131 yasa maddesi gere\u011fi korunmas\u0131 gerekli kentsel dokular\u0131n birlikte bulundu\u011funu alanlard\u0131r.<br \/>\na) Bu alanlarda, arkeolojik de\u011ferlerin sa\u011fl\u0131kl\u0131 ve kapsaml\u0131 envanter \u00e7al\u0131\u015fmas\u0131n\u0131n yap\u0131lmas\u0131na, bu \u00e7al\u0131\u015fma sonucunda haz\u0131rlanacak planlar onanmadan, parsel \u00f6l\u00e7e\u011finde uygulamaya ge\u00e7ilmemesine,<br \/>\nPlanlama \u00e7al\u0131\u015fmalar\u0131 s\u0131ras\u0131nda;<br \/>\n&#8211; Alana gelecek i\u015flevlerin uyumuna,<br \/>\n&#8211; G\u00fcn\u00fcm\u00fcz ko\u015fullar\u0131n\u0131n gerektirdi\u011fi altyap\u0131 hizmetlerinin proje a\u015famas\u0131ndan itibaren k\u00fclt\u00fcr katman\u0131na zarar vermeyecek ve toprak kullan\u0131m\u0131n\u0131 en alt d\u00fczeyde tutacak bi\u00e7imde ele al\u0131nmas\u0131na,<br \/>\n&#8211;
